Terms and Conditions for Tree Surgeons Manorpark

Tree surgeons carrying out professional arboricultural workThese Terms and Conditions set out the basis on which Tree Surgeons Manorpark provides tree surgery and associated arboricultural services to domestic and commercial clients. By booking any service, the client agrees to these terms. They are intended to create a fair and clear agreement covering the booking process, pricing, payment, cancellations, site access, waste handling, liability, and the legal framework that applies to all works carried out by our team of tree surgeons. If any part of these terms is not understood, the client should seek clarification before confirming a booking.

These terms apply to all quotations, inspections, scheduled works, emergency callouts, and follow-up services provided by tree surgery specialists. Unless otherwise agreed in writing, no employee, contractor, or representative of Tree Surgeons Manorpark has authority to vary these terms. Any verbal statement made during an enquiry or site visit will only form part of the agreement if it is confirmed in writing. The client is responsible for ensuring that any person instructing work on their behalf has authority to do so, whether the property is privately owned, leased, managed, or occupied under another arrangement.

Booking and site assessment for tree surgery servicesThe service scope may include pruning, crown reduction, crown lifting, crown thinning, felling, stump grinding, hedge management, deadwood removal, storm damage response, and related arboricultural tasks. Because tree work can be affected by access, weather, tree condition, and legal restrictions, the final method and timing may differ from initial estimates. The client acknowledges that all work is undertaken in accordance with applicable UK standards, reasonable professional judgment, and the condition of the tree at the time of attendance.

Booking Process

All bookings begin with an enquiry and, where necessary, a site assessment. Tree Surgeons Manorpark may provide an indicative quote based on photographs, description, measurements, or a visit to the property. A quotation will normally specify the agreed service, any assumptions made, and any exclusions. Quotations are valid for a stated period only and may be revised if circumstances change, including changes in tree condition, access, scope, waste volume, or legal requirements.

To secure a booking, the client must confirm acceptance of the quotation and provide accurate information about the site, including hazards, boundaries, utilities, parking restrictions, and any known planning or conservation constraints. The client must also disclose any circumstances that may affect safety or execution, such as weak structures, underground services, protected wildlife, or unstable ground. Where a site visit is required before final acceptance, the booking may remain provisional until all material information has been reviewed.

Tree Surgeons Manorpark reserves the right to decline or postpone work if the site conditions are unsafe, if required permissions are absent, or if the tree surgery requested cannot be completed lawfully or responsibly. On arrival, if the work differs materially from what was described or agreed, we may need to amend the quotation, change the method, or reschedule the job. Any changes will be discussed with the client before additional work is undertaken, except where immediate action is needed to reduce a serious safety risk.

Payments

Tree surgeons managing payment and service termsPayment terms will be stated on the quotation or invoice. Unless otherwise agreed, payment is due on completion of the work, or within the period shown on the invoice. For larger projects, specialist operations, or repeat commercial services, a deposit or staged payment may be requested before work begins. All prices are normally quoted in pounds sterling and, where applicable, may be subject to VAT at the prevailing rate.

The client agrees to pay all sums due without deduction, set-off, or withholding unless required by law. If any part of the work is varied, extended, or made more complex by site conditions or new instructions, additional charges may apply. These charges will be calculated fairly and, where possible, agreed with the client before extra work starts. Where the client asks for urgent attendance, out-of-hours support, or emergency tree surgery, premium rates may be applied if stated in advance.

If payment is not received by the due date, Tree Surgeons Manorpark may charge interest and reasonable recovery costs permitted under the law. We may also suspend further services, withhold waste removal beyond what is necessary to secure the site, or decline future bookings until outstanding amounts are settled. Title to any materials sold separately will not pass until full payment is received. The client remains responsible for timely payment even if the invoice is addressed to a third party on the client’s instruction.

Cancellations and Rescheduling

The client may cancel or reschedule a booking by giving notice as soon as possible. Because tree surgery work often requires scheduling staff, equipment, vehicles, and disposal arrangements, short-notice cancellations may involve a charge to cover reasonable losses. If cancellation occurs after the team has already attended site, or if access is prevented for reasons within the client’s control, the client may be charged for attendance, labour, and any non-recoverable costs incurred.

Where weather conditions, unsafe site conditions, equipment failure, illness, legal restrictions, or circumstances beyond our reasonable control make it impossible or inappropriate to proceed, Tree Surgeons Manorpark may postpone or cancel the appointment. We will act reasonably and seek to rearrange the work at the earliest practical date. We shall not be liable for delay caused by events outside our control, including storms, high winds, heavy rain, emergencies, traffic disruption, or unavailable access needed to complete tree surgery safely.

If the client wishes to amend the agreed scope, date, or location, the request must be made with sufficient notice to avoid unnecessary cost or delay. Tree Surgeons Manorpark may refuse a change that would make the work unsafe, unlawful, or materially different from the original agreement. In all cases, the aim is to keep the service efficient and fair while maintaining the safety of operatives, customers, the public, and surrounding property.

Liability and Site Safety

Safe tree surgery operations with liability considerationsTree work is inherently hazardous, and the client accepts that some risk remains even when work is carried out with care and professionalism. Tree Surgeons Manorpark will take reasonable steps to perform services with skill and diligence, but we do not guarantee that a tree will remain stable or free from defect after work is complete. Natural movement, hidden decay, subsurface roots, weather effects, and pre-existing structural issues may affect outcomes in ways that cannot always be predicted in advance.

Our liability is limited to direct loss or damage caused by our proven negligence, breach of contract, or failure to take reasonable care. We are not liable for indirect, consequential, or economic loss, including loss of profit, loss of business opportunity, or loss arising from a third party’s actions, except where such limitation is not permitted by law. Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

The client must take reasonable steps to protect valuables, vehicles, fences, ornaments, fittings, and vulnerable structures before work begins. While our team will work carefully and may use protective measures where appropriate, the client should remove or secure items that could be damaged by falling timber, debris, machinery movement, or access requirements. The client is also responsible for ensuring pets, children, and unauthorised persons remain clear of the working area during operations.

Waste Regulations and Material Removal

Lawful green waste handling and disposal after tree workAll green waste, timber, branches, foliage, and arisings removed during tree surgery will be handled in accordance with applicable waste legislation and good environmental practice. Unless specifically agreed otherwise, waste produced by the work becomes the responsibility of Tree Surgeons Manorpark for lawful transport, segregation, transfer, and disposal or recycling through appropriate facilities. Waste transfer arrangements may be documented where required by law.

The client must not assume that all material will be removed unless the quotation clearly states that waste disposal is included. In some cases, timber may be left stacked on site at the client’s request, or logs and woodchip may be retained for reuse if this has been agreed in advance. Any such arrangement must still comply with safety, access, and environmental obligations. If the client asks for materials to be left on site, they accept responsibility for their storage, movement, and further use after handover.

Tree Surgeons Manorpark will not knowingly dispose of hazardous materials, contaminated waste, or regulated substances without proper assessment and the necessary lawful arrangements. If such materials are discovered during the work, operations may be paused until the matter is addressed. The client must disclose any known contamination, treated timber, invasive species concerns, or other waste-related issues before the job starts. Additional charges may apply where extra handling, specialist transport, or separate disposal is needed due to site conditions or legal requirements.

Client Responsibilities

The client must ensure that access routes, parking arrangements, and working space are available on the agreed date. This includes making sure gates can be opened, vehicles can enter where required, and any barriers, overhead obstacles, or locked areas are identified in advance. If access is delayed or prevented, we may need to alter the schedule or charge for wasted attendance time. The client is also responsible for obtaining consent from landlords, managing agents, neighbours, or other relevant parties where their agreement is required.

Before any tree surgery begins, the client should inform us of known underground services, overhead lines, drainage systems, irrigation pipes, concealed structures, or other features that may be affected by the work. Although we will use reasonable care, the client remains responsible for providing accurate information about hazards that are not obvious on inspection. Where permission, licence, or planning consent is needed, the client must ensure this has been obtained unless we have expressly agreed in writing to do so on the client’s behalf.

Any boundary dispute, ownership uncertainty, or property access issue should be resolved before the work starts. Tree Surgeons Manorpark is entitled to rely on the client’s instructions and representations unless there is a clear reason to doubt them. If there is a risk of trespass, dispute, or legal challenge, we may suspend or decline the service until the matter is clarified. This helps protect both the client and our team from avoidable conflict or non-compliance.

Guarantees, Complaints, and Service Standards

Because tree surgery affects living assets and natural growth, no guarantee is given that a tree will respond in a particular way after pruning, reduction, or other intervention. Growth patterns, seasonal changes, disease progression, and environmental conditions all influence future development. Any advice provided is given in good faith based on the condition of the tree at the time, but it should not be treated as an absolute prediction. Where specific outcomes are important, they should be discussed and recorded before work starts.

If the client believes that a service has not been delivered in accordance with the quotation or these terms, the issue should be raised promptly so that it can be reviewed. Tree Surgeons Manorpark will consider concerns fairly and may inspect the work, request photographs, or arrange a further visit where appropriate. This process does not affect any statutory rights the client may have under UK consumer law. However, dissatisfaction arising from changes in tree appearance that were inherent in the agreed work will not, by itself, amount to a breach.

We aim to maintain a professional standard across all arboricultural services, using suitable equipment, trained personnel, and proportionate methods. Where specialist techniques are required, these will be selected based on the site and the nature of the tree. The client accepts that access equipment, climbing methods, machinery, and cutting techniques may vary according to what is safe and efficient at the time of attendance. Minor adjustments may be made without prior notice if necessary to complete the work competently.

Governing Law

These terms and any dispute or claim arising from them are governed by the law of England and Wales. The parties agree that the courts of England and Wales shall have exclusive jurisdiction, except where mandatory law provides otherwise. If any provision of these terms is found to be invalid or unenforceable, that provision shall be interpreted, limited, or severed only to the extent necessary, and the remaining provisions shall continue in full force.

The contract between the client and Tree Surgeons Manorpark is formed when the client accepts a quotation, confirms a booking, or otherwise instructs us to proceed. No waiver of a right or remedy shall be effective unless agreed in writing. These terms represent the entire agreement between the parties in relation to the relevant service, subject to any mandatory legal rights that cannot be excluded. By engaging our tree surgeons, the client confirms acceptance of these conditions and acknowledges that tree surgery services require flexibility, safety awareness, and lawful waste handling at every stage.
